COMPULSORY ACQUISITION OF LAND
CORK CITY COUNCIL – PASSAGE RAILWAY GREENWAY IMPROVEMENT SCHEME, PHASE II – MAHON TO PASSAGE WEST ACQUISITION ORDER NO.1 OF 2023
Cork City Council (hereinafter referred to as “the local authority”) in exercise of the provisions of section 76 of the Housing Act,1966 and the third Schedule thereto, as amended by section 198 of the Residential Tenancies Act 2004, as extended by section 10 of the Local Government (No.2) Act, 1960 substituted by section 86 of the Housing Act, 1966, as amended by section 6 and the second Schedule to the Roads Act, 1993 and as amended and extended by The Planning and Development Acts, 2000-2022(including Part XIV, Section 213, Section 213(2) and Section 222 thereof); Local Government Acts 1925-2019 including sections 11 and 184 of the Local Government Act, 2001; Roads Acts 1993-2015 and Part XIV of the Planning and Development Act, 2000 and all other Acts, has made an order entitled as above which is about to be submitted to An Bord Pleanala for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the lands described in the Schedule Part 1 hereto together with any easement, wayleave, water- right or other right over or in respect of the said lands or water or any sub-stratum of the said lands for the purposes of performing its functions under the Planning and Development Act, 2000 including giving effect to and facilitating the implementation of the City Development Plan. The order will also authorise the local authority to temporarily acquire the lands described in the Schedule Part II pending the completion of the works. The order will also authorise the local Authority to permanently acquire the easement described in the Schedule Part III.
Owners, lessees and occupiers of the lands described in the Schedule Part I, Part II and Part III will receive individual written notice.
The Board cannot confirm –
a compulsory purchase order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land and not withdrawn, until it has caused to be held an oral hearing into the matter and until it has considered the objection and the report of the person who has held the oral hearing.
A copy of the order and of the map referred to in it may be seen between the hours of 10am to 4pm on working days between the 19th of January 2023 and the 10th of March 2023 at the reception desk of Cork City Council, City Hall, Cork.

1. Starting at a point on the public roadway approximately 5 metres north of the boundary wall at the eastern side of the entrance to Heritage Business Park, thence in a southerly direction for 11.5 metres to a point on the boundary wall, thence in a westerly direction into Heritage Business Park for approximately 0.4 metres, thence in a northerly direction for 11.5 metres through the entrance area of Heritage Business Park to the public roadway and returning to the starting point in a easterly direction for 0.4 metres.
2. Starting at a point on the public roadway on the eastern side of the entrance to the public walkway at Bessboro, thence in a southerly curving direction following the eastern boundary of the public walkway for approximately 532 metres to a point approximately 23 metres north of the N40, thence in a northerly curving direction for approximately 532 metres in a line following the public walkway and returning to the starting point in an easterly direction for 5 metres.

Starting at a point on the western boundary of the public walkway at Bessboro with Heritage Business Park approximately 100 metres south of the entrance to Heritage Business Park, thence in a southerly curving direction along the public walkway for approximately 100 metres to a point on the eastern boundary of Mahon Industrial Estate, thence in a north westerly direction for 13 metres to a point 4 metres north of the southeastern corner of Heritage Business Park, and returning to the starting point in a curving northerly direction following the boundary of Heritage Business Park for approximately 91 metres.

Starting at a point on the public walkway at Bessboro approximately 98 metres north of the N40, thence in southerly direction along the public walkway for 17 metres, thence in a westerly direction for 3 metres to the boundary of the walkway and a further 1 metre into Mahon golf club lands, thence in a southerly direction for 4 metres along the edge of Mahon golf club, thence in a north westerly direction along the edge of Mahon golf club for 20 metres and returning to the starting point in a north easterly direction for a distance of 5.5 metres.
